Canadian News Companies Take Legal Action Against OpenAI

A number of media and journalistic organizations in Canada sued OpenAI on Friday, claiming the ChatGPT developer had violated their copyrights and unfairly benefited from their work.

The Globe and Mail, the Toronto Star, the Canadian Broadcasting Corporation, and other businesses are suing OpenAI in an attempt to prevent them from using their work in the future and obtain monetary penalties.

According to the news organizations, OpenAI trained the massive language models that underpin ChatGPT using content that was collected from their websites.

The content is 

“the product of immense time, effort, and cost on behalf of the News Media Companies and their journalists, editors, and staff.”

The companies share their opinion and said 

“rather than seek to obtain the information legally, OpenAI has elected to brazenly misappropriate the News Media Companies’ valuable intellectual property and convert it for its own uses, including commercial uses, without consent or consideration.”

Additionally, YouTube producers and authors, including comedian Sarah Silverman, as well as The New York Times and New York Daily News are suing OpenAI for copyright. 

Although OpenAI has licensing agreements with publishers like Axel Springer, Le Monde, and The Associated Press, the firms bringing the current lawsuit said they have

 “never received from OpenAI any form of consideration, including payment, in exchange for OpenAI’s use of their Works.”

An OpenAI spokesperson shared in a statement about ChatGPT is

“hundreds of millions of people around the world … to improve their daily lives, inspire creativity, and solve hard problems,” and that its models are “trained on publicly available data, grounded in fair use and related international copyright principles that are fair for creators and support innovation.”

“We collaborate closely with news publishers, including in the display, attribution and links to their content in ChatGPT search, and offer them easy ways to opt-out should they so desire,”
